摘  要:用人单位处罚权是一种不同于行政处罚权和国家刑事处罚权的权利。它的根椐和性质的认定应借鉴、综合几种主要学说特别是固有权说和契约说的合理观点,修正其片面之处。用人单位处罚权的内容有三项,对其行使必须符合一定的有效要件。而我国当前用人单位处罚权的行使比较混乱无序,需要加强对它的法律规制。Employers' power of penalty is a kind of right which differs from the power of administrative or criminal penalty. It should be based on rational views of some theories, especially the theory of intrinsic power and the contract doctrine. There are three items in the contents of employers' power of penalty, and some legal requisites that employers should abide when penalties are executed. But now in today's China, penalties are imposed by employers quiet confusedly. It needs to be standardized by law rules and regulations.
