高校内部学生管理规定的性质、价值定位与法律规制

摘　　要：公立高等学校的法律地位以及“大学自治”的传统和要求都决定了公立高校内部学生管理规定是学校受权执法和自主管理的有机统一。在依法治校、依法治教的经济社会发展背景下,内部学生管理规定在内容安排和程序设计上应当服从高等教育的基本宗旨并遵从“以人为本”的精神和原则。为实现对内部学生管理规定的有效法律规制,应当通过完善立法确保在其制定过程中遵循和贯彻法律保留原则、比例原则以及民主程序保障原则等行政立法一般原则,并应在进一步加强行政监督的同时允许司法机关对其进行有限的司法审查。The legal position of higher educational institutions has fostered the fact that regulation of students in higher education institutions is the combination of administration of law by institutions and institutions＇ independent management. So have the trattition and the requirement of such institutions＇ autonomy. Against the background of economic and social development in the view of such institutions＇ administration and education, according to the law, regulation of students in higher educational institutions should be consistent with basic guidance of higher education and the spirit and principle of “human -oriented”. In order to make effective the regulation of students in public higher education institutions, we should improve the stipulation of law and follow and carry out the general principles such as the Principle of Reservation, the Principle of Proportion and the Principle of Democratic prooedure. Meanwhile, administrative supervision should be further enhanced and limited judicial review by legal organization should be allowed.
