摘  要:中国社会处于转型过程中,传统的师生关系受到冲击。师生关系应由权威型走向民主平等型。师生关系包括两个方面,一是"教育性"关系,一是管理关系。"教育性"关系涉及人的内在精神世界,不由法律调整,由道德、习俗调整。管理关系行为作为准行政关系,应纳入法律调整的范围。但这又分为两种情况,一种是对学生权益产生重大影响的基本关系,由法律调整;一种是对学生权益无重大影响的非基本关系,属于教学自主权的范围,不由法律调整,由学校的内部规则调整。With the rapid change of society in China, traditional relationships between teacher and student are challenged greatly. The relationships between teacher and student must become equal from autocracy. The relationships between teacher and student include educational relationship and management relationship with the former involving the spiritual world regulated by morals and customs, but not by law, and the latter, a semi-administrative relationship, regulated by law. However, management relationship includes two kinds: basic relationship which has a great influence on students' rights should be regulated by law, and the non-basis relationshipwhich doesn't exert a great influence on students' rights should be regulated by the internal regulations of school, but not by law because it belongs to the teaching autonomy of schools.
