摘  要:通过分析自然文化遗产地控制旅游建设用地失效的原因,认为在目前我国规制手段不健全、管理体制不顺的情况下,城镇化和旅游经济高度发展的阶段,自然文化遗产地的农地流转为旅游建设用地将不可避免。在自然文化遗产地的保护和经济增长两个要素中间寻求一种动态的平衡,必须要充分发挥政府和市场的机能,设计一种机制使当地居民在受土地用途管制的同时向社会受益群体索取补偿。本文提出借鉴海外土地发展权制度,在自然文化遗产地配置可移转的土地发展权的内生机制,作为控制旅游建设用地"隐性市场"的有效管制方法。Through analyzing the reason of the rural land transferring to the tourism construction land in nature & culture heritage sites, the article points out that the problem is inevitable based on the fact that the role of the government has not fully played while the urbanization and tourism industry is rapidly developing. The dynamic balance between the protection of the heritage sites and the growth of the economy should be made. A kind of the mechanism can be designed that the local residents whose land is strictly regulated by the government should get the compensation from the other social beneficial groups. The government and the market must exert the function themselves. By drawing experience of land development right system of foreign countries and regions, the paper then puts forward that the adoption of land development of in nature & culture heritage sites is an effective way to impose control over the problem of the rural transference. Although land development right system has been carried out successfiully for a long time in some market-economy countries, the policy cannot be adopted completely in nature & culture heritage sites in China because of the difference of the land system. The detailed operation of land development right allocation policy in nature & culture heritage sites includes several aspects: definition of the ownership of land development right by law, floor area ration instead of land development right to evade the temporary lack of the law, multi-aimed policy of the rural land protection, the regulation of the land utility, the market exchange mechanism of the land development right. The government should establish the mechanism of the market exchange so that the local resident can get compensation enough to take an active part in the conservation of the heritage resource. In that way, the rural land can get better protection and meanwhile restrict the hidden exchange of the tourism construction land.
