摘　　要：当前，随着社会主义市场经济和个项事业迅速发展，中国的消防工作面临着许多新情况、新问题。长期以来，公安消防机构在处理火灾事故责任时，凡涉及刑事案件、需要追究刑事责任的，全部移交公安机关。根据《公安部刑事案件管辖分工规定》，公安消防机构要员责独立办理消防刑事案件中的失火案和消防责任事故案，这是法律赋予的使命和职责，Starting from the four criminal essentials, the article elaborates the cencepts and characteristics of the crime of fire by negligence and the crime of fire accident by negligence, it alse expounds the way to determine the crime, with the emphasis on the differences between acquittal and convictien of the crimes and the dissimilarities with ether similar crimes.
