信用证结算中期前违约制度研究

摘　　要：1980年《联合国国际货物买卖合同公约》对英美法系的预期违约制度和大陆法系的不安抗辩制度进行了吸收、借鉴,形成了综合两大法系的期前违约制度。但是,《公约》调整范围是有限的,国际贸易的复杂性对这一传统的期前违约制度提出了挑战。本文试以信用证为付款方式的国际货物买卖为例,对买卖双方的期前违约行为及其相应的救济途径进行分析,以期能服务于外贸工作人员的贸易实践,尤其为之在遭遇信用证结算中的期前违约行为时提供一些启示。1980 ＂ United Nations Convention on contracts for the International Sale of Goods＂ （CISG） absorbs and draws on anticipatory breach system of Common Law Family and Unstable Counterplea system of Civil Law Family to form a comprehensive view of anticipatory repudiation system. However, CISG adjustment range is limited, the complexity of international trade raises a challenge to the traditional anticipatory repudiation system. Taking the LC payment for the international sale of goods for example, this paper tries to research on the anticipatory repudiation behaviors and its corresponding remedies in order to serve to the trade practice, especially while the trade staff encounter the anticipatory repudiation during the LC payment.
