摘　　要：通过美国历史上两个著名案例的分析,说明法律实践离不开哲学洞察力。这种哲学洞察力,使法律不仅仅局限于维系社会秩序,而是主导一种新的社会生活方式。The practice of law is not without the philosophical intuitivism ,the point is illuminated by two famous cases in America.this philosophical intuitivism let law not only in the localization of maintaining social order, but also leading a new life style in society.
