摘　　要：商业贿赂犯罪是因商业贿赂行为触犯了刑法的禁止性规定而构成的犯罪,是一类犯罪行为的概括称谓,本身并非规范的法律术语。商业贿赂犯罪严重危害市场经济秩序的形成和发展,破坏公平竞争、平等有序的市场行为准则。商业贿赂犯罪与贿赂犯罪在外延、主体范围及犯罪目的等方面均有不同。准确界定商业贿赂犯罪的界限范围,厘清商业贿赂犯罪的构成特征和"贿赂"的内容,是认定商业贿赂犯罪的关键。The crime of commercial bribery refers to the crime that is committed by the action of commercial bribery breaking the prohibited provisions of the criminal law. It is a general term, instead of a normative legal term, of a kind of the criminal actions. The crime of commercial bribery seriously hazards the formation and development of the market economical order, destroys the market rules of fair competition and equitable order. The sticking point of identifying the crime of commercial bribery is to circle the boundary of the crime of commercial bribery exactly, to understand the structural characteristics of the crime of commercial bribery and the contents of ＂bribery＂.
