摘　　要：我国现行的中药专利保护制度没有充分利用《与贸易有关的知识产权协议》(以下简称TRIPS)协定的弹性条款,从而使我国的中药专利保护遇到困境,造成我国传统中药复方资源的大量流失。要积极推进我国中药专利保护与TRIPS的立法协调,建立适应保护我国传统中药复方的专利制度,从而获得我国中药复方应有的利益。Our present patent protection system for Chinese Traditional Medicine, which does not fully utilize the elastic clauses of TRIPS agreement and makes patent protection for Chinese Traditional Medicine face to many difficulties,even causes Chinese compound prescription resources to drain massively. We should push forward Chinese patent legislation by which we could obtain to coordinate with TRIPS to establish a patent system adapting to the protection for Chinese traditional compound prescription, thus obtains the benefit which Chinese compound prescription should have.
