摘　　要：高等学校的依法管理是依法治校的重要组成部分。依法管理所施行的学校制定的规章制度的体系结构,由学校章程、内部管理体制机制、教学科研人事学生财务管理、民主管理监督、申诉案件办理等五个方面的规章制度组成。在当前高校依法管理工作中,要认真探讨和改进"校内法"与"校外法"相违背、规章制度制定和废止的权限和正确处理"依法管理"与"以人为本"的关系等三个问题。Managing higher learning institutions according to laws and regulations is an important part for managing colleges and universities by laws and regulations. The laws and regulations, which are implemented by the colleges and universities, are composed of laws and regulations in five aspects such as constitution, inner management system and mechanism, management of teaching and scientific research personnel affairs, human resources, student affairs and financial affairs, democratic management and supervision, and management of appeal cases. In the process of current management of higher learning institutions according to laws and regulations, three relations should be carefully discussed and improved such as the relationship between laws and regulations inside schools and laws and regulations outside schools, relationship between the rights for making laws and regulations and the rights for abolishing laws and regulations, and the relationship between management by laws and regulations and management based on people.
