摘　　要：证人作证豁免规则是证人作证义务原则的重要制度保障。对比分析德、日、美和我国台湾地区规定的该项规则,对于设置我国的证人作证豁免规则会起到良好借鉴作用,在我国实现证人作证豁免规则需制定符合其精神的基本内容和必要的程序保障,并应符合我国证据法的立法体例和具体国情。The Immunity of witness rule is the important composition and system guarantee of the principle of Witness＇s duty. The article analyses the immunity of witness rules of Germany, Japan, American and Taiwan, and gives a conclusion that those rules could be used as good reference in our country. The Immunity of witness rule should has some basic content, proceeding guarantee, and should accord with the legislative system and realities of Chinese evidence codes.
