摘　　要：中国传统调解制度是植根于中国传统社会的"地方性知识"。这一法律制度是中国传统无讼文化的最佳追求、中国传统熟人社会和中国传统秩序统治的理性选择。中国法治理想的实现必须深深依赖于对中国传统调解制度的挖掘与升华。The Chinese traditional mediation system is a kind of ＂local knowledge＂ which rooted in Chinese traditional society. It is the best pursuit of Chinese traditional＂ No lawsuits＂ culture. The Chinese traditional society about acquaintanceship have no alternative to use the Chinese traditional mediation system. It is the rational choice for Chinese traditional rule of the order. Achieving the ideal about the rule of law must be deeply dependent on the excavation and sublimation about Chinese traditional mediation system.
