摘 要:"凶宅"是指曾发生人为因素致人死亡的或地处异常地段的房屋,它是一种客观存在的现象而非源于主观感受。忌讳"凶宅"并非良俗,不能运用民法公序良俗原则进行调整。"凶宅"应被认定为房屋的瑕疵,因隐瞒"凶宅"而为房屋交易产生的纠纷需运用诚实信用原则进行调整,并适用合同法规则救济买受人。Haunted houses are caused by special surroundings or unnatural death due to man-made factors. Haunted houses should be regarded as a kind of extension phenomena. Tabooing said houses is a kind of superstition in stead of folk-custom. Haunted houses should be regarded as defects of houses. Any dispute arising from dealing of such houses due to sellers' fraud should be adjusted by principle of Bona Fides in civil law. And the rules of contract law will provide relief to buyers.
