对推动图书馆立法策略的思考

摘　　要：认为业内人士20多年来为制定图书馆法所做的诸多努力中,存在着立法策略的偏差:一是地方立法动作缓慢、数量少,对现行地方立法的现实作用和经验总结不够,可供国家制定统一图书馆法的经验不足;二是社会参与不够,特别是司法实践部门对立法的需求不迫切。指出进一步推动图书馆立法的策略:一是加强地方立法,循序渐进推动国家立法;二是图书馆实践与司法实践相结合,以司法需要推动国家立法。The paper firstly looks back on the lots of efforts made by legal experts on legislating the library law in the past twenty years, experiences coexist with defects, and thinks that there exists the deviation of promoting the legislation strategy： One is the slow operation and small amount efforts made to promote the legislation of the local library law, the realistic function and experiences is short and are not provide enough references for government to enact a unify library law. The other is that social participation is less, and the requirements of judicatory practice department for legislation is not so urgent. Then the paper points out the strategies in library legislation, that is one to strengthen the local library legislation, promote the national legislation step by step; the other is to combine the library experiences and judicatory practices and promote the national legislation by requirements.
