摘　　要：容隐制度是我国历史上存续了两千多年但现行刑法废除了的一项制度。容隐其实不仅符合人性需要,同时也符合我国现阶段建设社会主义和谐社会的需要,且当代一些经济发达国家的立法例也为我国的刑法引入容隐制度提供了很好的借鉴作用。本文从容隐行为的主体、主观方面、客体以及客观方面等技术层面,探讨了在我国刑法中创设容隐制度的问题,以求在立法上恰当界定容隐,使法律最大限度地发挥打击犯罪、保护人民的功能。Having been a basic system in Chinese feudal society, the hidden system was abolished in Chinese present criminal law. In fact, it fitted the demands of personality and met the needs of society in our country at present. Our country may draw lessons from some developed countries to introduce this hidden system. This paper discussed the problem of designing hidden system from the aspects of subject and object, etc.. Which aimed at defining this system in law and making the law protect the people at the most.
