摘 要:按揭在我国的房地产业广泛使用,而其真正涵义却非常模糊。笔者从按揭的语源出发,分析了我国内地按揭的操作规则与适用方法,即购房人以买卖合同项下权益作为担保,向银行申请贷款,同时开发商作为购房人不能按期还款付息的保证人,承担回购义务或连带保证责任的一种担保方式。从而得出融入中国法律背景的按揭的真正涵义。Mortgage is widely used in real estate in China, but its real rneaning is not very clear. The author analyzes the operation rules and application methods of our local mortgage in terms of the origin of "mortgage", and proves that it is a way of guarantee in which pruchasers of a house regard the rights and interests under the terms of business contract as a guarantee and apply for a bank loan; in the meantime developers, as a guarantor of the purchaser of the house who can not pay money and interest on time, take on the responsibility of buy back or related guarantee duty, finally reaches the real definition of mortgage mixing together in the background of Chinese law.
