摘　　要：随着高等教育改革和高校社会化进程的推进,学校和学生之间的法律纠纷频发。现行法律制度对学生合法权益的保护存在缺陷,有必要对高校和学生的法律关系进行深入的法理分析,重新确定二者的法律地位,探讨构建高校学生管理纠纷解决的法律机制,引入司法审查制度,提出制度完善建议。With the reform and socialization of college education, conflicts between students become more frequent. The current legal system falls short for the protection of the students＇ rights. It is imperative to carry out a deep analysis of the legal relationship between higher schools and students to reconfirm the legal status of both parties. The construction of legal system for the settlement of the conflicts of the management of students in higher schools will be discussed along with some suggestions.
