摘 要:从工资债权诉讼时效的适用基础、起算、期间等不同角度对我国工资债权诉讼时效制度建设中的若干疑难问题进行探讨。主张工资债权是一种继续性给付债权,工资债权应当适用统一的诉讼时效;工资债权诉讼时效的起算点是"劳动争议发生之日",这里的"劳动争议发生之日"应当根据劳动关系存续期间和劳动关系解除或终止之后这2种情况而分别确定;工资债权应当适用普通诉讼时效期间甚至长期诉讼时效期间,以加强劳动者利益的保护。This article analyzes several knotty questions about the prescription of action of wage creditor's right from the points of basis of prescription, the beginning of prescription and duration of prescription. It is held that the wage creditor's right is a kind of continuous payment creditor right, hence a uniform prescription of action should be applied. Meanwhile the beginning of prescription of wage creditor' s right is the day when the labor dispute takes place which depends on whether the labor relationship still exists or the labor relationship is terminated. A longer duration of prescription should be applied in order to strengthen the protection of the laborer' s interests.
