证券投资者民事赔偿请求权之实现

摘　　要：投资者进入证券交易市场,其投资行为实属契约行为,但因某种法律事实的出现,亦可能导致两种或两种以上民事责任的产生进而出现权利受损主体请求权之竞合。证券投资者请求权主要体现为要求有关行为人承担违约责任;或侵权行为人因其侵权行为而承担法律上的不利后果,此为法定责任。When an investor comes into the securities exchange , his investment is a contractual conduct in essense. it can lead to two or more civil liabilities only because of certain legal facts. Thus, the conflicts of the parties＇ claims for damages comes into being. The investor＇s claim mainly embodies that the person concerned should take on the liability for contract or the tort infringer ought to accept the liability for tort, and the latter is statutory.
