摘　　要：2005年10月公司法与证券法同时进行修正,对国内的证券金融制度造成一定程度的改变,但是。利用证券交易制度的漏洞所进行的新形态市场操纵行为也随之发生。为了配合2005年证券法的修正,2006年6月的刑法第六次修正也针对第182条的犯罪构成要件进行修改。根据修法后的内容,操纵行为的对象扩及证券交易量,对于冲洗买卖也采用实质性判断,因此本罪应当称为操纵市场罪,其性质应当属于行为犯。The company law and the securities regulation were carried on the correction in October 2005. It results the change of the financial system in local securities market. But the behavior that making use of the loophole of the securities exchange system to manipulate the securities market also take place immediately. In order to matching with the correction of the securities regulation in 2005, the penal code of June 2006 revises for the sixth time also the crime of aim at Article 182s constitutes the important item to carry on the modification. According to the contents of criminal law revising, the objects of manipulating behavior expand the trade amount about securities. And it takes the material judgment about the wash sales. So this offense should be called the crime of manipulating securities market. Its nature should belong to the behavior crime.
