摘 要:随着技术标准与专利的日益结合,技术标准下的专利池日渐成为举足轻重的专利许可主体。本文以发展中国家为视角,剖析了技术标准下的专利池对我国自主创新的影响。在专利池形成过程中,企业进入专利池的预期对我国自主创新有强激励作用,同时也可能导致重复研发。专利池所依附标准的不确定性也可能导致自主创新的迟滞。专利池形成之后,通过促进技术扩散和技术溢出,将有利于我国自主创新能力的提高。但另一方面,专利池的知识产权滥用行为则会对我国的自主创新产生消极影响。同时,专利池内部的“搭便车”行为和在位厂商地位也可能会妨碍创新。With the combining of technology standard and patent, the technology standard' s patent pool is becoming more and more important patent licenser. A perspective of developing country is adopted and the impact of technology standard' s patent pool on self- determined innovation of China is analyzed. During the forming patent pool, the anticipation into the pool can strongly inspirit Chinese self - determined innovation, but also lead to overlap of R&D activity. On the other hand, the uncertainty of technology standard may hinder self - determined innovation. After formation of patent pool, it can improve innovation abili- ty through promoting technology diffusion and spillover. At the same time, the intellectual property right misuse of patent pool as well as "free-riding" in the pool and the status of incumbents could block innovation.
