摘　　要：行政不作为与行政不履行法定职责一直以来都被作为相同的行为对待,但是两者在含义、性质、构成等方面均存在差异。只有准确界定行政不作为与行政不履行法定职责,精确分析行政不作为与行政不履行法定职责的外延、内涵、性质以及它们的构成,并加以区别对待,才能切实保障行政相对人的合法权益。Inactive administration and unfulfilled administration have been treated as the same act though they are different in meaning, nature and structure. Only can a clear distinction between them and a precise analysis of their extension, connotation as well as the nature and structure be made, the legal rights of administrators will be safeguarded consciously.
