摘　　要：针对刑法和保障人权之间的关系进行辨析,通过对人权属性,保障人权的含义和刑法的价值取向等问题的探讨,将刑法保障人权的对象界定于无辜的一般人和犯罪人,并得出刑法保障人权不仅是应然的向往,还是实然的需要的结论,进而探讨了连接刑法和保障人权的要素。The article mainly aims at between criminal law anti the safeguard human rights relations carries on the discrimination,discussion the questions on human rights attribute, safeguard human rights meaning and the value orientation of criminal law and so on, the criminal law safeguard human rights object limits to the innocent average person and the crime person, and obtains the criminal law safeguard human rights should he yearning for, or the solid need conclusion, then has discussed the essential factor of the connection between the criminal law and the safegmard human rights.
