摘　　要：《中华人民共和国政府信息公开条例》已经于2007年1月17日国务院第165次常务会议通过,将自2008年5月1日起施行。但政府信息公开行政诉讼依然是行政诉讼的前沿问题之一,现实中也出现了少量的例子。在操作中具体做法也不尽相同,有关政府信息诉讼的理论论述并不多。本文尝试从政府信息公开的行政诉讼种类、可诉的法律依据、法院受理以及判决等几个方面进行论述,以期引起一些争鸣。＂The Rules and Regulations Concerning the Information Publicity of the People＇ s Republic of China＂ was approved at the 165th session of the State Council on January 17, 2007 and will take effect from May 1,2008, Yet, the administrative proceedings concerning the publicity of government information remain a problem rarely explored in theory and practice. This paper studies the types, foundation, lawsuit procedure and verdicts involved in this field.
