摘　　要：我国司法实务界和法学理论界对行为保全的研究主要局限在对特点、功能的操作层面,而对法律性质、具体的立法制度的设计研究的较少。本文拟从行为保全的法律性质问题的研究入手,对这一重要的民事诉讼法律制度相关的立法理念进行解说,并对行为综合的"广义特别程序"等司法观念作一剖析。For a long time, researches by judicial experts and scholars have been limited on the legal features and functions of action preservation system instead of its essence and the design of its legislative system.
