赃款购买体育彩票的善意取得问题——以邯郸农业银行库款失窃案为例

摘　　要：善意取得是民法的一项重要制度,旨在保护财产的善意取得人。但是赃物、赃款是否适用善意取得,尚存在争议。研究认为,赃款购买体育彩票应当适用善意取得制度。如果彩票发行人为善意,不知道该笔款项为赃款,且为此支付了足额的彩票价值,即便当事人用赃款购买彩票,彩票发行人也没有义务返还票款;反之,则应当退还票款。Possession in good faith is an important civil law to protect the owner. There have been diputes over whether illicit money can be used in possession in good faith. This study holds that possession in good faith is applicable for illicit money for sports lottery. If the issuer of the sports lottery does not know it is illicit money and has printed the lottery, even if the purchaser has paid with illicit money, the issuer is not obliged to return the money. Or else, the money should be returned.
