中文刑事判决书语体的人际意义研究

摘　　要：中文刑事判决书语体作为具有法律效力的非规范性文件,具有特定的人际功能。本文以Halliday系统功能语言学为理论依据,以中文一审刑事判决书为研究对象,着重分析人际意义在中文刑事判决书各组成部分中的特点及其语言表现方式,从情态、语气和指称系统三个方面阐释中文刑事判决书语体中所揭示的人际意义,并寻求其法律上的相关解释和依据。Chinese criminal judicial verdicts, as a formal legal document, can be seen as one of the genres of written texts. It has its own specific interpersonal function. This paper examines the proceedings of the first trial phase concerning written verdicts of Chi- nese criminal courts, and reflects on Halliday＇ s Systemic Functional Grammar while doing so. The primary data used in this study are analyzed for characteristics of interpersonal meaning, including its speech forms realized in the different parts of written verdicts and the meanings encoded in those parts. The specific grammatical resources of these characteristics can manifest themselves in modality, mood and reference system. These linguistic forms, which are unique to Chinese language, can affect specific interpersonal meaning in Chinese written criminal decisions. From a linguistic point of view, the interpersonal functions can be identified in written verdicts, providing legal interpretations and evidence of these functions.
