摘　　要：刑法适用技术是刑法应用理论中的一个新名词,属于刑法应用方法论范畴。刑法适用技术在认定犯罪过程中处于刑法理论应用的"间接活动"环节,离不开刑法方法论的指导;刑法方法论是研究认定犯罪方法的学问。Penal technology of applicability is a new term in the applicable penal theory, which belongs to the category of applicable methodology in the criminal law. It is a link of “indirect activity” in the application of penal theory, which is guided by the methodology. Penal methodology is the subject of studying criminal cognizance.
