贿赂罪的特殊证据规则探析

摘　　要：当前我国贿赂犯罪手段日趋多样隐蔽,证据来源单一取证难度加大,出现立案难、有证难、定罪难的新态势,证据问题日益成为困扰司法实践的突出问题,因此有必要借鉴国外反贿赂立法经验,针对贿赂犯罪证据的特殊性,采取了一些特殊的证据规则,以适应反腐败斗争的需要。Now the means of bribing crime in our country present diversiform and covert trend, the source of evidence is haploid and the difficulty of getting evidence increases, a new situation of the difficulty of Case registering, investigating and Conviction appears, evidence problem become an outstanding problem to worry judicial practice, so it is necessary to use overseas lawmaking experience of against bribe for reference, for the particularity of bribe crime evidence, adopt some special evidential rules to fit the demand of corruption against.
