英国证人制度浅议

摘　　要：文章通过对英国证人资格、权利义务制度设置等有关方面的考察得知:英国证人制度具有系统性和科学性的特点。而我国的证人制度由于各方面的原因,在理论和实践上都存在一定程度的缺失。针对此,提出应借鉴英国经验完善我国的证人制度,即建立证人作证权利义务对等机制,设立专门机构加强证人权利保护,确立证人作证豁免权等。By reviewing British witness system, this paper comes to a conclusion that British witness system has the characteristic of system and science. However, due to various reasons, Chinese witness system is lack of good foundation both in theory and practice, which results in the loss of evidence rules and disordered judicial practices. Therefore, this paper puts forward some suggestions for the improvement of Chinese witness system.
