摘　　要：在学校体育教学、训练、竞赛及课外体育活动中发生意外伤害事故的案例时有发生,因事发生原因复杂,加之我国在处理学校体育意外伤害事故中法律规定不是很明确,这就给责任认定带来难度,给责任双方的合法权益都带来很大的伤害。本文通过对学校体育意外伤害事故的法律适用及防范伤害事故的发生予以研究,以期对我国学校体育意外伤害事故处理的立法提供参考意见。Cases of sports accidents are commonly seen in school sports class, sports training, sports contests and out-of-class activities. The causes of these accidents are usually very much complicated. Furthermore, the law terms relating to the treatments and solutions of such accidents fail to be very specific in China up to now. Consequently, there has been much uncertainty in the determination of responsibility for the accidents involved. This, in turn, results in much harm on the lawful rights of both sides. This paper tends to study the proper application of law terms related to these accidents and suggest ways to prevent such accidents from occurring. Finally, the paper aims to propose some practical references to certain legislation institutions over the treatment of these school sports accidents.
