关于农村宅基地使用权流转的法律思考

摘　　要：我国农村宅基地使用权法律制度存在一些缺陷,其立法基础和标准不统一,导致现行相关法律规定相互矛盾。我国应确立完善的农村宅基地使用权登记制度,逐步建立农村宅基地有期限、有偿使用制度,在条件成熟时以立法形式规范农村宅基地使用权的流转。Some deficiencies exist in the system of the fight to use the rural residential land in China： the basis of legislation and standards are not unified; and the current relevant laws and regulations contradict to each other. China should establish a sound regis- tration system dealing with the fight to use residential land, and implement a period of paid use of the rural house. When conditions are ripe, the state should regulate applying fight and transfer of the rural house by legislation.
