摘　　要：章程是民办高校依法成立的前提要件,也是其依法治校、自主管理的基本依据。充分认识民办高校章程的内涵与作用,是组织制定民办高校章程的重要基础。制定和完善民办高校章程,必须遵循主体明确、依据充分、要件齐全、权责对等和程序公正原则。The constitution is a prerequisite for the establishment of private higher education institutions as well as the basis of the governance and self-management of institutions according to law. Understanding the connotation and function of the constitution fully is the important foundation for private higher education institutions to organize their constitutions. And to develop and improve the constitutions we must follow the principles as elear target, full evidences, complete elements, equal rights and responsibilities and the impartiality of the procedures.
