摘　　要：法律对教师权利保护的不充分和教师个体力量的微弱,需要教师工会发挥维护教师权利的主体作用。工会维权是组织义务和法律义务,可以弥补教师个体维权的不足。然而教师工会组织的行政化、对工会工作内容的错位认识以及法律手段的有限性决定了工会维权的困境。在现有的制度框架内,推动工会自身建设的民主化、成立专业教师维权委员会、建立劳动关系协调机制等工作就成为当务之急。The Teacher＇s Union has organization obligations and legal obligations to maintain teachers＇ rights. However, the Union confronts a dilemma while maintaining teachers＇ rights due to the bureaucracy in the Union, incorrect understanding of its functions and limitations of legal remedy. Under the administration of the present regulations, it is urgent to strengthen the democratization of the Union by establishing a professional committee and a coordinating mechanism of labor relationships to maintain teachers＇ rights.
