诱惑侦查的理性分析与法律规制

摘　　要：诱惑侦查是世界各国普遍适用的刑事侦查手段,具有打击犯罪的高效性和侵犯人权的高风险性。基于理性的立场,借鉴美日等国的成功经验,诱惑侦查不能因为我国立法上的空白而被完全禁止或完全放任,诱惑侦查可以使用,但必须在法律规定的限度内。排除"犯意诱发型诱惑侦查"的合法化,肯定"机会提供型诱惑侦查"的合法化,对诱惑侦查的实施主体、适用范围、适用对象等予以明确合理的法律规制,以寻求打击犯罪与保障人权的平衡。Seductive spy is an ordinary investigation method which is widely used in other countries all over the world. It has high effieeney of striking on crime and high risk of invading human rights. Based on the rational station and reference to the experience of American and Japanese,Seductive spy should not be forbidden or indulged completely owing to its blank in our legislative field but used legally. We should exclude the legalization of seduetive spy by seducing the eriminous desire and affirm the legalization of seductive spy by offerring the chance. The balance between the ensuring of human rights and striking on crime should be achieved through dear and logical legal prescript of seduetive spy of the implementary main body, applied range and object.
