责任伦理:自由裁量权公正行使的理性诉求

摘　　要：现代经济社会发展的需要日益凸显了行政自由裁量权的合理性价值,同时由于自由裁量权本身固有的"自由"裁断属性,裁量权的行使者偏离法律精神和公正原则而引发的公正失范现象不免存在。解决此问题的方法,我们主张,不是简单限制或剔除自由裁量权,理性方法是在制度之外辅以责任伦理来确保这种裁量自由以一种符合民主、公正要求的负责任的方式行使。责任伦理是一个"不单纯的混合物",是对"管理中心主义"所确立的最低限度的责任规定的超越,构建行政人员责任伦理成为一个至关重要的伦理课题。With the development of modern society, the rationality value of the administrative jurisdiction is increasingly standing out. On the other hand, because of the ＂ freely verdict＂ attribute inherent in the administrative jurisdiction, there are really exists deviations from the principles of law and fairness in the process of exercising the administrative jurisdiction. To solve the problem, it is not to simply restrict or get rid of administrative jurisdiction, but to promote responsibility ethics besides the laws and regulations to ensure that the administrative jurisdiction conforms to the requirement of the democracy and justice. Responsibility ethics is not a simple mixture, but an transcending of the minimal limit of responsibility established by Management Centricity. It＇s a crucial moral subject to construct administrators＂ responsibility ethics.
