摘　　要：证明责任的分配决定了诉讼的成败,由于我国目前产品责任法还不完善,在产品责任诉讼中证明责任分配的规定还很落后,导致处于弱势群体的消费者利益得不到有效地保护。文章分别从理论上、立法上和司法上三个方面就产品责任诉讼中证明责任分配的完善提出了建议。The distribution of proofing the burden decides the end of lawsuit. Because of the imperfect product duty law in present China, the regulations on the distribution of proofing the burden are far backward, which causes the consumers who are vulnerable groups pretected ineffectively, The paper puts forward several suggestions on the improvement of the distribution of proofing the burden from three aspects of theory, legislation and justice.
