摘 要:"买断工龄"是因企业改制或企业资产发生重大变化而导致的劳动关系的解除。其有劳动法的依据,但其规定过于笼统,从而导致"买断工龄"侵犯职工合法权益,有必要进行立法。在立法方面,应当针对包括国有企业在内的企业改制或企业资产发生重大变化而导致的劳动关系的解除进行规制,保证程序公正,赋予职工集体谈判权,把"买断工龄"争议纳入劳动仲裁和诉讼解决的轨道,加强政府责任。" Buying out length of service" is a kind of rescission of labor relation caused by enterprise restructure or important transformation of asset according to ordains of the Labor Law of PRC. But the law ordains are so general that "buying out length of service" infringes the labors' legal rights, therefore lawmaking on the issue is a must. The legislative must regulate the rescission of the labor relation, ensure justice of procedure, en- dow the labors with collective negotiation right, settle the dispute of "buying out length of service" by arbitration and litigation, and strengthen the liability of the government.
