摘　　要：我国农村宅基地使用权法律制度存在一些缺陷,其立法基础和标准不统一,导致现行相关法律规定相互矛盾。我国应确立完善的农村宅基地使用权登记制度,逐步建立农村宅基地有期限、有偿使用制度,在条件成熟时以立法形式规范农村宅基地使用权的流转。The system of the fight to use the rural residential base in china has many deficiencies. Because the basis of its legislation and the standards are not unified, which has led to the contradiction of current relevant laws and regulations. China should establish a sound registration system of using the land with time limit and pay. When the conditions of rural house fight, and gradually implement a system are ripe, it is necessary to regulate the transfer of the right of using rural residence land through legistration.
