责任伦理:规范行政自由裁量权的理路

摘　　要：现代经济社会发展的需要日益凸显了行政自由裁量权的合理性价值,同时由于自由裁量权本身固有的"自由"裁断属性,裁量权的行使者偏离法律规定和公正原则而引发的公正失范现象不免存在。解决此问题的方法,我们主张不应简单限制或剔除自由裁量权,理性的方法是在制度之外辅以责任伦理,确保这种裁量自由以一种符合民主、公正要求的负责任的方式行使。The development of modern society has highlighted the rational value of the administrative jurisdiction. And because of the ＂free verdict＂ attribute of the administrative jurisdiction, the unjust judgment does exist for the deviation from the principles of law and fairness. The solution to the problem lies not in the restriction or rejection of administrative jurisdiction but in responsibility ethics, which, besides regulations, can ensure that the ＂free verdict＂ is conducted democratically, fairly and responsibly.
