摘  要:征地补偿作为征地过程中的核心问题,直接关系到被征地农民的利益与征地工作能否顺利进行。从一个全新的角度思考征地补偿问题,即征地补偿的"三阶段"说:一是纯行政行为的补偿,对应于这种性质的是行政补偿,该模式的测算是满足失地农民基本生存权的需要;二是半市场化行为,这种行为的补偿是一种基于"效用"的"等价交换";三是市场定价,在这种定价模式下,征地通过中介机构评估定值。同时,分析了3种价格之间的关系及变化趋势,并指出3种定价模式适用于不同的历史时期和发展阶段。最后总结了3种模式的不足,并对征地问题的解决阐明了自己的立场。IRegarded as the core issue of land expropriation, the compensation in land expropriation is correlated with the benefit of peasants whose land was expropriated and the smooth process of land expropriation. We propose a new conception of "three - step" in compensation in land expropriation based on the two acquaintances as above. The first is the compensation with pure admininstrative action. The compensation is administrative correspond to this property. The calculation of this model fulfil the demand of the basic life fight of peasants whose land was expropriated. The second is a halfmarket action and the relative compensation is an equivalent exchange based on unity that is called the model of Equitable Cost Pricing. The connotation of compensation in land expropriation under this model is changed with the development of economy and society. The third is priced by market. The value of land is evaluated by agencies under this model. We analysis the correlations between the three price and the variation trend, whereas point out the applicable period and developing process of the three pricing model. Finally, we conclude the limitation and elucidate my standpoint on the issue of land expropriation.
