内幕信息犯罪主体身份之辨

摘　　要：我国刑法理论通说认为内幕信息犯罪属于纯正身份犯,但通过考察我国立法精神以及西方发达国家的刑法理论,发现通说值得商榷。从法解释学的角度,我国现行立法中的内幕信息犯罪应当解释为非身份犯;从立法论的角度,该罪应当规定为不纯正身份犯。The current authoritative viewpoint in our country regards the subjects of the inside information crimes as special ones. On the basis of reviewing the legislative tenet of the Criminal Law and the theories of advanced countries, however, there is a doubt on it. At the angle of interpretation, the inside information crimes provided in Criminal Law belong to non - status offenses ; at the angle of legislation theory, the crimes should be stipulated as non -standard -status offense in legislation process.
