摘　　要：当前,涉油气犯罪呈高发态势。犯罪分子盗窃破坏油气资源及生产设备行为猖獗,非法开采、倒卖、炼制原油行为屡禁不止,违章占压油气管线造成重大安全隐患,涉油气犯罪日益集团化、专业化、暴力化,已严重危及国家油气资源安全和油气田的生产秩序,且极易诱发危害公共安全和重大环境污染事故,造成无法估量的经济损失甚至不可逆转的生态灾难。采用综合分析方法,对涉油气犯罪的概念进行了学理界定,以近几年来涉油气犯罪相关数据和典型案例为依据,从经济发展不平衡、社会转型期矛盾凸显、法律滞后、宣传教育等方面探讨了涉油气犯罪居高不下的原因,有针对性地提出了法律主导、综合治理的防控对策。Currently,the crimes in oil and gas sector are increasing in numbers and degrees. Those crimes include rampant conducts of stealing oil and gas and even the equipments in the fields,illegal extraction,buying in and selling out,crude oil refinery repeatedly banned but committed again and again,violated occupying or pushing down oil and gas pipelines resulted in high risks in safety,and the criminals have been organized under groups,by specialized training administration,and even by force and violence,which has threaten the security of national oil and gas resource and the normal operation works in oil and gas fields, being prone to serious accidents with immeasurable economy loss and irreversible environmental disasters. By use of the synthesis analysis method,the concept of crimes in oil and gas sector is defined by academic interpretation. According to the related data and some typical cases from recent years' crimes record,this paper discusses on the main reasons of the increasing crimes in oil and gas sector from many aspects including the imbalance of developing economy,apparent conflicts in the economies in transition,laws and regulations lagging behind,being lack of public education,and so on,and accordingly puts forward positive prevention and control measures should be dominated by the laws and legislations and under the assistance of being governed in a proper way. This study will provide valuable reference for oil and gas companies and operators to effectively prevent and control many possible criminalities.
