摘 要:行业协会的公共权力包括行政管理权和自律权两种类型,前者来源于法律、法规授权或政府委托,而后者则出自会员通过契约的让渡。从理论上讲,任何一种公共权力都有可能偏离其预定轨道、背离其追求公共利益的本原目标,行业协会所享有的公共权力也不例外。现实中,行业协会公共权力的"懈怠"或"滥用"现象并不罕见。要保证行业协会的公共权力在既定轨道上正常运行,以法律角度看,应当分别从设立体制、权力规制、救济途径三个方面入手,完善现有的法律制度。The public power of Trade Association includes the administration authority and selfz discipline power. The former is authorized by law or the government while the later sources from the Trade Association regulations. Theoretically, any kind of public power has the possibility to go away from the legal track, departing from its initial goal of serving for the public, and the public power of Trade Association is no exception. In reality, there is no wonder that the public power of Trade Association would be "slacked off" or "abused". In order to guarantee its normal and lhgal operation, from the perspective of law, three ways should be taken as the resolutions to perfect the existing law systems, they are establishment of power system, ruling of the authority and remedying respectively.
