论破坏交通工具罪的客体及对象

摘　　要：刑法理论对于破坏交通工具罪侵害的客体以及犯罪对象理解不一,但是能否正确理解交通运输安全的含义、能否正确圈定此罪的对象范围直接影响到司法实践中对此罪的认定,因此很有必要对这两个问题进行深入的探讨。事实表明,凡是因交通工具的被破坏或被毁坏而直接导致的或连带产生的对公共安全的危害都应当纳入到交通运输安全的考虑范围之内,同时将通说所认为的破坏交通工具罪的犯罪对象——"正在使用中的交通工具"修改为"关涉交通运输安全的交通工具"才更为合理。Understanding about the object and target of the Crime of Sabotaging Means of Transportation are different in criminal law theory, but whether understand the meaning of transportation security correctly and whether select the object scope of this crime correctly will influence the determination on this crime directly in judicial practice, therefore, ifs necessary to dis- cuss these two questions thoroughly. In fact, all detriment to the public security caused by the dilapidation to means of transportation directly or jointly and severally should be incorporated the consideration scope of transportation security, meanwhile, it＇s more reasonable to revise the target of the Crime of Sabotaging Means of Transportation from ＂the transportation vehicle that is using＂ which general theory considered to ＂the transportation vehicle that is relate to transportation security＂.
