摘 要:为了探究抵押权追及效力制度之设计,运用比较分析法、文献分析法等方法,对大陆法系与我国抵押权追及效力制度进行比较分析,并对与该制度设计有关的几个问题——抵押人能否转让抵押物、动产抵押问题、代价清偿和涤除权、物上代位权等进行剖析。研究表明:我国抵押权追及效力制度,应在承认抵押人有权转让抵押物前提下,将抵押物分为已登记的不动产、准不动产和未登记的其他动产,合理运用善意取得制度,在赋予抵押权人追及权和买受人一定限度取得所有权的同时,以最大限度求得各方利益平衡。To study the system design of force of hypothec recourse, comparative analysis and literature analytical method are applied. Related problems such as the right to transfer mortgaged property by mortgagor, mortgage of personal property, cost liquidation, elimination right and real subrogation are studied, which indicates that on the basis of admitting the mortgagor' s right to transfer mortgaged property, the mortgaged property should be divided into registered real property, quasi-real property and unregistered personal property, and bona fide acquisition should be applied reasonably to balance maximum interest respectively while entitling mortgagor to recourse and buyer to limited ownership.
