摘 要:《物权法》20条确立了预告登记制度,其制度价值是维护交易安全,保护处于弱势地位的债权人的利益。但同世界各国预告登记制度相比,我国预告登记适用范围较为狭隘,局限在因双方协议所产生的不动产买卖中。为了使这一制度有更大的价值发挥空间,应当借鉴各国立法,从请求权范围、请求权发生的原因、对象等方面来扩大预告登记的适用范围。The 20th article of Real Right Law establishes the system of registration of caution whose institutional value is to maintain exchange security and protect interests of creditors at weak status. Compared with other countries' systems of registration of caution world-widely, the applicable range of registration of caution in our country is relatively narrower because it is limaed within real estate business arising from two parties' agreement. To make the system function in a larger scope, other countries' legislations should be used as references including the range of right of claim, the cause for right of claim as well as the object of right of claim to expand the applicable range of registration of caution.
