司法亚文化正向功能分析

摘　　要：与主流司法文化相对应存在一种司法亚文化。这种亚文化形态是指司法机关和司法人员①按照其亚文化的价值观念和行为规范,为达到正当或非正当的目的,采用越轨和违法方式从事违反司法理念和原则的行为。②司法亚文化有正向功能和负向功能之分。其正向功能主要表现为:主流文化的必要补充;心理调适;增强群体内部凝聚力等。In contrast to mainstream judicial culture, there exists a judicial subculture. It refers to judiciary and their staffs, in accordance with its subculture value and behavioral mode, taking a type of illegal or deviant behavior to attain a rational or irrational goal. Judicial subculture function can be classified into negative function and positive fimction. The latter one, which is the key content of this article, mainly includes： necessarily supplement to mainstream culture; dealing with psychological problems; improving cohesive forces.
