摘　　要：中国历史悠久,地域宽广,且各地民情不一,在长期的社会发展过程当中,形成了众多而又极具特色的民商事习惯,与国家成文法一起规范着各类民事和商事行为。为因应民商事立法和裁判的需要,近代中国曾开展了两次全国性的大规模民商事习惯调查运动,取得宏富成果,为制订民商事法律、促进民商事裁判提供了参考依据,成为中国法律近代化历史进程中的厚重一笔。China has a very long history, vast region and various cultures. In the long social development process, various trading conventions which, together with statute laws, regulated different civil and commercial actions, came into being with many peculiar features. In order to satisfy the needs of civil trading legislation and judgment, modem China carried out two large scale investigations about the folk commercial conventions and made great achievements which provided foundations for the establishment of folk commercial laws and the promotion of folk commercial judgment, making great contributions to the modernization of Chinese legislation .
