驰名商标法律问题的几点思考

摘　　要：我国法律对驰名商标的有关规定存在一些问题,驰名商标由部门规章加以界定,其法位阶太低,在立法上显得不严肃、不权威,应反省驰名商标的认定方式,在完善行政认定制度的同时,提高司法认定驰名商标的审级法院的级别;对高度著名的非注册驰名商标给予跨类保护。There are some legal problems on well - known trademarks. It is not appropriate to stipulate well - known trademarks by ministry regulation under the state council. Too many well - known trademarks are identified by courts , which makes it not authoritative. Well - known trademarks are protected unfairly. Highly well - known non - registered trademarks should be protected to different kinds of commodities.
